Refund and Cancellation Policy

Effective Date: January 10, 2026

This policy governs all services provided by Texans Crown Towing (“Company,” “we,” “us,” “our”), including towing, roadside assistance, recovery, dispatch coordination, storage, administrative services, and all vendor network or subcontractor-fulfilled services.

By requesting service, authorizing dispatch, or submitting payment, the Customer (“you”) affirmatively agrees to this policy.

1. DISPATCH = SERVICE COMMENCEMENT

For the purposes of American Express, Visa, Mastercard, and Discover dispute rules, dispatch constitutes the commencement of service.

Once a service request is dispatched, the Company has:

  • Allocated labor and equipment
  • Reserved operational capacity
  • Assigned a provider (Company unit or subcontractor)
  • Initiated routing and coordination

Accordingly, the Dispatch Fee is earned immediately and is non-refundable once dispatch occurs, regardless of whether the service is ultimately completed.

2. NO REFUNDS — COMPLETED OR NOT COMPLETED SERVICES

All services are provided on a no-refund basis once dispatched, including:

  • Completed services
  • Attempted services
  • En-route services
  • On-scene assessments
  • Vendor or subcontractor mobilization

Completion of service is not a condition for payment.

This structure complies with American Express guidelines, allowing merchants to charge for services rendered or initiated when terms are clearly disclosed and accepted.

3. VENDOR NETWORK & SUBCONTRACTOR SERVICES

Texans Crown Towing may fulfill service requests using independent contractors, affiliates, or vendor networks.

By authorizing service, Customer:

  1. Appoints Texans Crown Towing as its agent to engage third-party providers
  2. Acknowledges that third-party mobilization is a billable service event
  3. Agrees that once a vendor or subcontractor is dispatched, all fees are final and non-refundable

Vendor and subcontractor charges are governed by this policy, not by the vendor’s internal policies.

4. CUSTOMER-CAUSED NON-COMPLETION ≠ REFUND

No refund will be issued for non-completion due to:

  • Incorrect or incomplete service location
  • Customer absence or unavailability
  • Locked gates, blocked vehicles, missing keys
  • Unsafe or restricted conditions
  • Police or property instructions
  • Customer refusal after assessment

Under American Express rules, failure to receive a service due to the customer’s circumstances does not invalidate a properly authorized charge.

5. STORAGE, WAIT-TIME & ADMINISTRATIVE FEES

Once incurred, the following fees are non-refundable:

  • Storage fees
  • Administrative or processing fees
  • After-hours fees
  • Gate or release fees
  • Wait-time charges
  • Documentation or compliance fees (where permitted by law)

6. CARD NETWORK AUTHORIZATION & DISCLOSURE (ALL MAJOR CARDS)

This policy is structured to meet or exceed:

  • American Express Merchant Regulations
  • Visa Core Rules
  • Mastercard Chargeback Guide
  • Discover Network Rules

Customer expressly authorizes Texans Crown Towing to charge the provided payment method for all applicable fees, including non-refundable dispatch and service charges.

7. RECORDED CALL AUTHORIZATION

Customer acknowledges and agrees:

  • Calls may be recorded for verification and authorization
  • Verbal consent on a recorded call constitutes affirmative authorization
  • Recorded confirmation of no-refund terms is valid evidence in chargeback proceedings

Typical recorded confirmation includes acknowledgment that:

  • Dispatch fees are non-refundable once dispatched
  • Services are non-refundable whether completed or not
  • Vendor and subcontractor services are included

8. DIGITAL OPT-IN & ELECTRONIC ACCEPTANCE

Customer may authorize service via:

  • Online checkout
  • SMS confirmation
  • Email authorization
  • Digital signature or acceptance checkbox

Electronic acceptance constitutes binding consent and satisfies American Express requirements for card-not-present authorization.

9. CHARGEBACKS & PAYMENT DISPUTES

If a dispute is filed, Texans Crown Towing will submit:

  • Recorded call authorization
  • Digital acceptance logs (timestamped)
  • Dispatch records
  • Vendor assignment confirmation
  • GPS and routing logs
  • Itemized invoices

Customer agrees these records constitute valid proof of authorization and service initiation.

Filing a chargeback does not nullify agreed-upon no-refund terms.

10. LIMITED EXCEPTIONS (SOLE DISCRETION)

Refunds may be issued only for:

  • Duplicate charges
  • Billing errors
  • Verified third-party fraud

All other charges are final.

11. GOVERNING LAW

This policy is governed by the laws of the State of Texas, and applies regardless of service location.

12. ACCEPTANCE OF TERMS

By requesting service, authorizing dispatch, or submitting payment, Customer confirms that they:

  • Read and understood this policy
  • Accepted no-refund terms
  • Authorized dispatch and charges
  • Consented to recorded calls and digital authorization
